November 2009 (Volume 4, Issue 11)

Dear Paddocks Press Fan

Prof. Graham PaddockLots of exciting things are happening. We are all about to close for the annual year-end holidays and Jennifer is about to get married! But at the same time we mark the premature loss of Alastair, a Durban colleague.

In this November 2009 issue:

1. I give a personal overview of the CSOS and STSM public participation programme;
2. We remember Alastair Lomas-Walker;
3. The Training Team presents pictures from the 8th presentation of the University of Cape Town Sectional Title Scheme Management Certificate Course;
4. Jennifer examines the role of sectional title chairpersons;
5. Rob continues his regular property maintenance articles with "Paint Shmaint #2";
6. Jennifer answers sectional title questions in her regular Q & A column; and
7. We provide you with details of our forthcoming training courses.

Regards,
Graham

Update on the public participation process

By Prof. Graham Paddock

For readers who will not be able to attend any of the Information Sessions, I give a report on the process thus far. This is not an official or comprehensive report but my personal overview of the process.

The first Information Session was held on 16 Nov 2009 at the CSIR Conference Centre in Pretoria and the second on 20 Nov 2009 at the Durban International Conference Centre. The third session will be held on 27 Nov 2009 at the Southern Sun Hotel, Claremont in Cape Town. All the sessions are chaired by Ms. Nelli Lesholonyane (Deputy Director General: Corporate Services) and supported by Adv. Santie Burger and other Department staff. After the opening and an introductory talk there are two presentations on each Bill and then time for comments and questions. (reading time: ±6 mins)

Mike Addison

Specialist Sectional Title Attorney

By Prof. Graham Paddock

Prof. Graham PaddockAlastair passed away most unexpectedly last week after suffering a stroke. He was just 42 years old. He leaves his wife, Gertrud, his parents, Murray and Gill and his brother, Iain.

After qualifying as a lawyer in 1990, Alastair completed his articles in Johannesburg. He was admitted to practice and in 1993 returned to work in Westville, in the Greater Durban area. He started his own firm in 2001 and Siveshna Padayachee became his business partner in 2007. He was a specialist sectional title attorney who consulted on and acted as an arbitrator of sectional title disputes. He also did sectional title debt-collections, conveyancing, wills and estates. Chairpersons in Sectional Title Schemes

Jennifer Paddock

A thorough look at the Chairperson's role

By Jennifer Paddock

In sectional title schemes the chairperson can be mistaken for (or decide to be) “the king of the castle”. But although a committed chairperson may well work harder and take on more responsibility than the rest of the trustees, s/he does not have individual executive powers and may not make decisions relating to the scheme’s management on his/her own. The responsibility to manage the scheme falls onto the trustees as a group. (reading time: ± 3 mins)
